A) All attorney's are paid on a contingency fee basis in Minnesota. Workers Compensation statues outline how much an attorney can be paid for their services. The statute states that the attorney is entitled to 25% of the first $4,000 in compensation, and 20% of the next $60,000 in compensation up to a maximum fee of $13,000. Fees are only paid upon those benefits that are collected for you. There are other provisions in the statute that attorney's can collect attorney's fees as penalties that are paid for directly by the insurance company. But under no circumstance should you reach into your pocket to pay the attorney for representing you in a Workers Compensation claim.
