Q)  How do outside factors like bankruptcy and divorce affect a Workers Compensation MN claim?

A) Claims are particular to that individual.  If the employer files bankruptcy or the insurer files bankruptcy the employee still collects benefits through the Minnesota Guarantee Association.  If the employee files bankruptcy, that claim is not part of the bankruptcy  process unless it is listed as a contingent liability, that you would need to discuss with a bankruptcy attorney.  Because Workers Compensation plans are  specific to the individual, they are not subject to the divorce laws, unless there specific compensation for wage loss, that may be part of the divorce process but the permanent injury payment, the retraining benefit those other medical expenses are not part of the divorce process and are unique to the individual.
